What Is Probate?

Probate is an important aspect of estate administration. It is the legal process of confirming that a will is valid and that the executor named in the will has the legal authority to deal with the deceased’s estate. In British Columbia, probate is handled through the Supreme Court. Once the court grants probate, the executor can begin settling the estate—paying debts, collecting assets, and distributing what’s left to the beneficiaries.

If someone dies without a will (called intestate), a similar court process is required, but instead of granting probate, the court issues an “administration order” appointing someone to act as administrator.
